The majority of my caucus probably won\u2019t support it \u2026 but those of us who are in this national security environment understand it\u2019s got to get done.\u201d<\/p><p>The Senate Intelligence Committee advanced Clayton\u2019s nomination last week in a party-line vote, even though he declined to answer questions about the legitimacy of the 2020 election. Warner, however, has acknowledged Clayton\u2019s experience with intelligence matters; Clayton is currently the U.S. attorney for the Southern District of New York.<\/p>\n<p>Senate Republicans had initially hoped that Clayton\u2019s nomination would push Democrats to extend FISA before it expired in June, a plan that was <span><u>derailed after Trump instructed Clayton not to attend his hearing<\/u><\/span>.<\/p><p>Sen. John Barrasso of Wyoming, the Senate Republican whip, told reporters last week that he hopes Clayton\u2019s nomination will continue to move FISA forward.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=1810\">Mike Lee\u2019s Threats to Nix August Recess Are Infuriating His Colleagues<\/a><\/p><p>\u201cThe idea is to get things moving along as quickly as we can,\u201d Barrasso said. \u201cI want to get FISA reauthorized. I want to get the confirmation done. One has to be done before the other, and we expect to have him confirmed shortly.\u201d<\/p><p>Some Democrats on the intelligence panel told NOTUS that Clayton\u2019s appointment is enough for them to back FISA reauthorization.<\/p><p>\u201cWhen Bill Pulte is no longer the acting DNI, I think there\u2019s a path forward for FISA,\u201d said Sen. Mark Kelly (D-Arizona). \u201cThe hurdle is for the current, acting DNI to get that out of the way, and I think there\u2019s a path to try to expedite this.\u201d<\/p><p>Sen. Angus King of Maine, an independent who caucuses with Democrats, echoed Kelly, emphasizing that although Clayton is not the perfect candidate, it is time to renew the surveillance tool.<\/p>\n<p>\u201cI\u2019m ready to,\u201d King said when asked if he\u2019d support reauthorization. \u201cWe\u2019ve got a DNI in place, and then I\u2019m ready to move forward.\u201d<\/p><p>But other Democrats said they\u2019ll continue to oppose renewing the surveillance program altogether, even under a new intelligence director. Sen. Andy Kim (D-New Jersey), a former State Department adviser, told NOTUS he\u2019s long had problems with FISA \u2013\u2013 especially under the Trump administration.<\/p><p>\u201cThey made matters worse by bringing in Pulte, and that shook my confidence about what they\u2019re going to do with Clayton or anybody,\u201d Kim said. \u201cIt doesn\u2019t redress the underlying problems we had about the role of privacy and the role of the courts.\u201d<\/p><p>Even with enough Democratic support, the Senate may not hold a vote to renew the Foreign Intelligence Surveillance Act until members return in September.
