That\u2019s what independent expenditures are. It\u2019s the association of individuals to get together to speak.\u201d<\/p><p>But Americans  overwhelmingly believe there is too much money in U.S. politics, according to recent polling by <span><u>Politico<\/u><\/span>, <span><u>Pew Research Center<\/u><\/span> and <span><u>others<\/u><\/span>.<\/p><p>The 2026 midterm election is expected to be the most expensive non-presidential cycle on record, with well-funded super PACs \u2014 including the president\u2019s MAGA Inc. and those controlled by cryptocurrency, artificial intelligence and sports-betting industries \u2014 poised to play a major role in shaping the election landscape.<\/p>\n<p>Maine is <span><u>one of several states<\/u><\/span> that\u2019s attempted to limit the amount of money flowing into their elections, which has <span><u>exploded<\/u><\/span> since 2010, when the Supreme Court greenlit unlimited spending by outside groups in its Citizens United v. FECdecision.<\/p><p>\u201cThis case presents a single question: When the people of Maine decided, by the largest vote in the state\u2019s 206-year history, that unlimited super PAC contributions were corrupting their elections, did the First Amendment leave them powerless? It did not,\u201d Neal Katyal, a partner at Milbank LLP, who  against President Donald Trump\u2019s tariffs at the Supreme Court earlier this year, said during oral arguments Wednesday.<\/p><p>Lessig previously <span><u>told the Maine Morning Star<\/u><\/span> he had expected a legal challenge, and Equal Citizens joined the case to defend the contribution limits.<\/p><p>Lessig\u2019s <span><u>stated goal<\/u><\/span> is to get the case to the Supreme Court, which he argues hasn\u2019t grappled directly with the constitutionality of unlimited political contributions.<\/p><p>A few months after the Citizens United decision, a federal appeals court in D.C. appliedthe Supreme Court ruling to another case called <span><u>SpeechNow.org<\/u><\/span> v. FEC. The court ruled then that contribution limits, not just spending limits, were lawful, as did other appeals courts \u2014 and this is the precedent Maine and Equal Citizens are targeting.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=1946\">Trump Administration Wants Millions More to Pay Off Freedom 250 Events<\/a><\/p><p>\u201cThe strategy is to get this case to the Supreme Court with the First Circuit coming into contradiction with the precedents of other Circuits including the Second, Fifth, Seventh, Ninth, Tenth \u2014 and, most importantly, the DC Circuit,\u201d Maia Cook, Equal Citizens\u2019 executive director, wrote in a statement to NOTUS.<\/p>\n<p>In a written statement to NOTUS ahead of oral argument, Miller said the Maine ballot measure \u201cstrikes at the heart of the First Amendment by severely limiting political speech.\u201d<\/p><p>\u201cThere is no legitimate government interest in limiting contributions to groups that make only independent expenditures,\u201d Miller wrote.<\/p><p>The odds that the case makes it to the Supreme Court would rise if the federal appeals court sides with Maine and Equal Citizens, which would create a tantalizing <span><u>\u201ccircuit split\u201d<\/u><\/span> for the court.<\/p><p>Last July, a U.S. magistrate judge stopped Maine from enforcing the law, which she called \u201cunconstitutional on its face.\u201d<\/p><p>The federal appeals court is expected to rule in November or December, although there\u2019s no official timeline for releasing the decision.<\/p><p>Even if the case gets to the Supreme Court, however, Maine faces an uphill battle.<\/p><p>Conservative justices have sympathized with arguments that super PACs erode the power of political parties, in part fueling their decision last month to <span><u>strike down coordination limits<\/u><\/span> between political party committees and candidates.<\/p><p>But that doesn\u2019t mean justices are willing to limit super PACs\u2019 ability to spend as much money as they want to advocate for or against political candidates.<\/p><p>\u201c[D]onors can and do send their funds to Super PACs and other outside groups that have a First Amendment right to receive and spend unlimited money to support their independent political speech,\u201d conservative Justice Brett Kavanaugh wrote in the  last month.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=1944\">James Comey Accuses DOJ of Lying and \u2018Vindictive\u2019 Prosecution in Seashell Case<\/a><\/p>\n<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>But in federal court today, free speech advocates defended the right of political donors to make unlimited contributions to certain political groups.<\/p>\n","protected":false},"author":1,"featured_media":1951,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[14],"tags":[],"class_list":["post-1952","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-money"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
