{"id":2976,"date":"2026-08-25T17:54:40","date_gmt":"2026-08-25T17:54:40","guid":{"rendered":"https:\/\/modernhomejournals.com\/?p=2976"},"modified":"2026-08-25T17:54:40","modified_gmt":"2026-08-25T17:54:40","slug":"judge-dismisses-ghislaine-maxwells-frivolous-attempt-to-toss-convictions","status":"publish","type":"post","link":"https:\/\/modernhomejournals.com\/?p=2976","title":{"rendered":"Judge Dismisses Ghislaine Maxwell\u2019s \u2018Frivolous\u2019 Attempt to Toss Convictions"},"content":{"rendered":"<div>\n<div>\n<\/div>\n<div>\n<p>A federal judge forcefully rejected Ghislaine Maxwell\u2019s attempt to vacate her conviction and sentence for helping Jeffrey Epstein sexually abuse underage girls, ruling Tuesday that her claims of constitutional violations were \u201cfrivolous.\u201d<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=2974\">Mike Lindell Withholds Payment for Minnesota Election Recount<\/a><\/p><p>U.S. District Judge Paul Engelmayer in New York wrote in  that nothing in Maxwell\u2019s \u201clengthy and rambling\u201d petition \u2014 filed in December without assistance from lawyers \u2014 offered support to reconsider her five felony convictions or 20-year federal prison sentence.<\/p>\n<p>\u201cHer petition\u2019s claims are demonstrably meritless, and generally based on speculation, distortions, and\/or outright falsehoods,\u201d Engelmayer wrote. \u201cThere is no fact that Maxwell fairly puts in dispute that has any potential to disturb the outcome of her trial.\u201d<\/p><p>Maxwell, Epstein\u2019s longtime accomplice and former romantic partner, was convicted in 2021 of helping Epstein groom, traffic and coerce minors into sex with the late sex offender and well-connected financier. The move came shortly after Todd Blanche, then the deputy attorney general, interviewed Maxwell in Tallahassee amid uproar over the Justice Department\u2019s handling of files in the Epstein case.<\/p><p>Maxwell had sought a new trial and appealed her sentence and conviction without success. The Supreme Court declined to take up her case last year.<\/p><p>Maxwell\u2019s latest petition contained dozens of claims about what she said were errors and violations of her rights surrounding her trial in New York in 2021 and subsequent sentencing \u2014 none of which the judge found convincing.<\/p><p>In his bluntly-worded 67-page ruling, Engelmayer said Maxwell repeatedly misinterpreted legal issues, tacked irrelevant exhibits onto her filings and raised baseless arguments about how prosecutors handled her case. She also missed deadlines and raised claims that were barred under court procedure.<\/p>\n<p>In one claim, Maxwell argued she was selectively prosecuted, saying the Justice Department could have charged alleged co-conspirators or other men who entered into settlements with Epstein\u2019s victims. She does not point to any other person who abetted Epstein in this manner or to this degree,\u201d he wrote. \u201cOn the contrary, Maxwell has not implicated any other person in the child sex abuse scheme.\u201d<\/p><p>She also argued that documents in the trove of Epstein files released by the Justice Department showed that prosecutors had failed to turn over evidence that could have helped prove her innocence.<\/p><p>The judge disagreed, saying that, if anything, the materials showed that the prosecution team \u201cwent above and beyond its disclosure obligations.\u201d<\/p><p>Another of Maxwell\u2019s claims accused prosecutors of improperly colluding with victims\u2019 attorneys and manipulating them into bringing the charges against her.<\/p><p>The judge said prosecutors had acted appropriately in meeting with victims and their counsel.<\/p><p>\u201cProsecutors\u2019 conferral with and receipt of information from witnesses, victims, and other private actors \u2014 directly or through their counsel \u2014 is commonplace in the building of a criminal case and the preparation for a criminal trial,\u201d the judge wrote. \u201cIt does not transform such persons into members of the prosecution team.\u201d<\/p><p>The judge noted that many of Maxwell\u2019s claims had already been rejected by previous judges, and that she failed to raise others earlier in the proceedings.
