Among Talarico\u2019s asks: Tell Texas voters he supports capping insulin costs and \u201caffordable prescription drugs from Canada\u201d and opposes \u201cpuppet politicians.\u201d<\/p>\n<p>Lone Star Rising PAC, a super PAC primarily funded by billionaire LinkedIn founder Reid Hoffman, responded to the Talarico campaign\u2019s bat signal. It spent hundreds of thousands of dollars this year across major Texas media markets on <span><u>an ad<\/u><\/span> praising Talarico\u2019s advocacy for \u201ccap[ping] the cost of insulin at $25\u201d and \u201caffordable prescription drugs from Canada\u201d while fighting against \u201cpuppet politicians.\u201d <\/p><p>More than a dozen Democratic candidates in the nation\u2019s hottest congressional races have embraced \u201credboxing,\u201d a controversial election-season technique that provides super PACs and other moneyed outside groups with campaign materials without, <\/span>\n<\/h3><\/div>\n<\/div>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/section>\n<p>Five of these candidates removed \u201credboxing\u201d content after inquiries from NOTUS.<\/p><p>Such materials, which are sometimes surrounded by a red box on the campaign website, include messaging priorities and specific instructions for where and how to spend on advertising, according to a NOTUS analysis of campaign websites for candidates in the closest <span><u>House<\/u><\/span> and <span><u>Senate<\/u><\/span> races as rated by the nonpartisan Cook Political Report.<\/p><p>At least one Republican candidate also features a \u201credboxing\u201d memo, as do Democratic and Republican party committees, which are barred from directly coordinating messaging with super PACs.<\/p><p>Critics have characterized \u201credboxing\u201d as an effort to circumvent anti-coordination laws, which were put in place to insulate campaigns from potential political influence from donors or groups. The practice is either patently \u201c<span><u>illegal<\/u><\/span>\u201d or, at least,  the \u201cspirit of campaign-finance regulation,\u201d argue some supporters of stricter campaign finance rules.<\/p>\n<p>But the Federal Election Commission, the government agency that interprets and enforces federal campaign finance laws, has   that \u201credbox\u201d requests posted publicly, such as on a website, and available to a general audience do not count as illegal coordination.<\/p><p>Democratic and Republican political operatives alike acknowledge that in practice, the average voter is not in a position to act on \u201credboxing\u201d requests, nor are they the intended target. Super PACs and other outside groups, in contrast, may have hundreds of thousands or millions of dollars in reserve to help get their preferred candidate elected \u2014 and they\u2019re on the lookout for campaigns\u2019 wink-wink, nod-nod guidance.<\/p><p>The FEC has been effectively sidelined from making any new rulings this election cycle because it <span><u>doesn\u2019t have enough commissioners<\/u><\/span> to cast binding votes.<\/p><p>In the nation\u2019s closest congressional races, significantly more Democrats than Republicans use \u201credboxing\u201d messages on their websites this year, NOTUS\u2019 review indicates.<\/p><p>Democratic campaign websites with specific messaging and distribution requests include <span><u>Jamie Ager<\/u><\/span> in North Carolina\u2019s 11th Congressional District, <span><u>Christina Bohannan<\/u><\/span> in Iowa\u2019s 1st Congressional District, Rep. <span><u>Kathy Castor<\/u><\/span> in Florida\u2019s 14th Congressional District,  in Florida\u2019s 22nd Congressional District, <span><u>Christina Hines<\/u><\/span> in Michigan\u2019s 10th Congressional District, <span><u>Bobby Pulido<\/u><\/span> in Texas\u2019s 15th Congressional District and <span><u>Tom Suozzi<\/u><\/span> in New York\u2019s 3rd Congressional District. None of the campaigns responded to requests for comment.<\/p><div>\n<\/div><div>\n<\/div><p>In New Hampshire, three candidates vying for the Democratic nomination in the state\u2019s 1st Congressional District are using \u201credboxing\u201d ahead of their Sept. 8 primary: ,  and .<\/p>\n<p>Sullivan\u2019s  says her \u201cname should come up within the first five seconds of any ad.\u201d<\/p><p>A recent <span><u>video ad<\/u><\/span> from super PAC Vote Vets waits a little longer \u2014 11 seconds \u2014 before mentioning Sullivan by name. But the ad incorporates several specific themes and details from Sullivan\u2019s \u201credboxing\u201d page, including that she waited tables in college, served in Iraq and would fight corruption. Both the \u201credbox page\u201d and Vote Vets ad use the phrase \u201cnew generation of leadership.\u201d<\/p><p>Sullivan spokesperson Emmett Avery declined to comment. Representatives for Shaheen and Beriont did not respond to repeated messages.<\/p><p>Five Democratic candidates pulled down their redbox-style media pages after NOTUS reached out for comment: Reps.  of Texas,  of California and <span><u>Gabe Vasquez<\/u><\/span> of New Mexico; <span><u>Randy Villegas<\/u><\/span> in California\u2019s 22nd Congressional District; and <span><u>William Lawrence<\/u><\/span> in Michigan\u2019s 7th Congressional District.<\/p><div>\n<\/div><p>\u201cWe have no comment at this time,\u201d Lawrence spokesperson Mya Legel said in an email to NOTUS. The Gray, Gonzalez, Vasquez and Villegas campaigns did not respond to several requests for comment, including on their decisions to take down the redbox-style pages.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=2997\">Trump Wants Unity in Georgia. The Blood May Be Too Bad.<\/a><\/p><p>The \u201cMedia\u201d tab on Villegas\u2019 campaign website now redirects to the Democratic Congressional Campaign Committee\u2019s <span><u>\u201credboxing\u201d page<\/u><\/span> for the race, which includes <span><u>specific<\/u><\/span> talking points and a list of ZIP codes to target for digital advertising.<\/p>\n<p>Party committees are also legally prohibited from coordinating with outside groups. The DCCC has \u201credboxing\u201d pages for more than a dozen other competitive races, including \u201ctoss-up\u201d races in <span><u>Arizona\u2019s 6th Congressional District<\/u><\/span>, <span><u>New Jersey\u2019s 7th Congressional District<\/u><\/span>, <span><u>Texas\u2019 34th Congressional District<\/u><\/span> and <span><u>Washington\u2019s 3rd Congressional District<\/u><\/span>.<\/p><p>\u201cThe messages we post on these pages are intended for the general public and are fully consistent with the law and FEC guidance,\u201d DCCC Communications Director Courtney Rice said in an emailed statement to NOTUS.<\/p><p>Talarico\u2019s \u201credbox\u201d page, which his campaign updated and slimmed down in mid-August, previously stated it was \u201cmost important\u201d to reach voters in the San Antonio, Austin and Harlingen-McAllen media markets.<\/p><p>The Lone Star Rising PAC aired its ads in each of these markets and several more, including Dallas-Fort Worth and Houston. Collectively, prospective voters have seen the ad nearly 1.9 million times, according to political ad tracking firm AdImpact.<\/p><p>The Talarico campaign did not respond to several requests for comment. Lone Star Rising PAC also did not respond to requests for comment.<\/p><p>A few Republicans in key contests have also used \u201credboxing.\u201d<\/p>\n<p>The National Republican Congressional Committee, the party committee supporting House Republicans, has its <span><u>own \u201credboxing\u201d page<\/u><\/span> with specific instructions and requests for spending in competitive races.<\/p><p>The NRCC page for the \u201ctoss-up\u201d race in <span><u>Ohio\u2019s 9th Congressional District<\/u><\/span> reads: \u201cIt\u2019s imperative that voters are educated on Toledo broadcast, streaming and in their mailboxes districtwide, particularly in Henry, Putnam, and Paulding Counties (which are in the newly drawn OH-09), that [Rep. Marcy] Kaptur has voted for far-left policies that are out of [sic] out-of-touch and make our communities less safe.\u201d<\/p><p>The NRCC did not respond to requests for comment from NOTUS.<\/p><p>And in Florida\u2019s 25th Congressional District race, Republican candidate Scott Singer\u2019s campaign website  last month with information on \u201cHow Voters Need to Receive Positive Information on Singer.\u201d The Singer campaign does not link to the memo through a \u201cMedia Kit\u201d or other vague label, as others do, but within the image of a thin line at the bottom of the <span><u>campaign website<\/u><\/span> \u2014 an unusual placement that a general audience would be less likely to notice.<\/p><p>Saurav Ghosh, director of federal campaign finance reform at Campaign Legal Center and a former enforcement attorney at the FEC, is one of the leading critics of \u201credboxing.\u201d There is no exception explicitly written into the law for coordination via public platforms, Ghosh argues, and the practice undermines anti-coordination law that\u2019s intended to ensure independence.<\/p><p>But \u201cwhen big money is directly underwriting campaigns,\u201d Ghosh told NOTUS, \u201cyou end up with Congress, White House, an elected government that is directly indebted to big money interests, and nothing could be more corrosive to everyday Americans having a voice and being actually represented in their government.\u201d<\/p>\n<p>Sean Cooksey, a former Republican FEC commissioner, dismissed Campaign Legal Center\u2019s stance as \u201cpearl-clutching.\u201d<\/p><p>\u201cRedboxing is not illegal,\u201d and is \u201cnot a threat to democracy,\u201d Cooksey told NOTUS via email. \u201cI believe free speech is fundamental to democratic government and individual liberty.\u201d<\/p><p>As recently as 2022, Cooksey and his former colleagues at the FEC, including Trump-ousted Democratic commissioner Ellen Weintraub,  a complaint brought by Campaign Legal Center alleging coordination between a campaign and super PAC through social media.<\/p><p>When asked about candidates such as Talarico who campaign on getting big money out of politics but have these redboxing pages, Ghosh said it\u2019s \u201ca messaging point that maybe the candidates genuinely believe.\u201d<\/p><p>\u201cBut for purposes of their own campaign and how they\u2019re conducting their efforts to get elected, it\u2019s clear that if they\u2019re redboxing, they are asking super PACs to support them,\u201d Ghosh said.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=2993\">Darline Graham Secures the Nomination for Senate Despite Late Campaign Gaffes<\/a><\/p>\n<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Candidates can\u2019t legally coordinate with outside groups.
