Judge Strikes Down Democratic Redistricting Ballot Measure<\/a><\/p><p>On Wednesday, U.S. District Judge Fernando Rodriguez Jr. ruled against <span><u>Minnesota\u2019s attempt<\/u><\/span> to force Texas to turn over Christian Castro, 52, concluding that the state\u2019s lawsuit was filed too soon.<\/p>\n<p>\u201cBased on the current record, the court concludes that it lacks subject matter jurisdiction<\/p><p>because the case is not ripe for adjudication,\u201d Rodriguez, who was appointed to the federal bench by President Donald Trump in 2018, Greg Abbott refused to approve what is legally supposed to be \u201ca summary procedure\u201d in which a governor acquiesces to another state\u2019s request to send a defendant to another state to face charges.<\/p><p>However, the judge said that technically Abbott hasn\u2019t said no \u2014 he just hasn\u2019t made a decision yet.<\/p><p>\u201cGovernor Abbott has not denied the request for a rendition warrant,\u201d Rodriguez wrote. \u201cMinnesota alleges that Governor Abbott has \u2018refused to sign\u2019 and has \u2018with[eld]\u2019 the rendition warrant. But the record reflects only that Governor Abbott has neither agreed nor refused to sign the rendition warrant as to Castro.\u201d<\/p><p>Texas law only allows the state to jail someone for up to 90 days when that person is a fugitive wanted in another state.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=3049\">Pentagon Claims Hegseth\u2019s Afghanistan Withdrawal Probe Found \u2018Hidden\u2019 Files<\/a><\/p>\n<p>In court, Minnesota had alternatively asked that Cameron County Sheriff Manuel Trevi\u00f1o not release Castro from jail until the Texas governor signed a rendition warrant. However, Rodriguez wrote that \u201cno grounds support a temporary restraining order requiring Sheriff Trevino to ignore the dictates of Texas Code of Criminal Procedure.\u201d<\/p><p>Minnesota Attorney General Keith Ellison, who filed the lawsuit, said in a statement that Abbott was \u201cplaying with constitutional fire.\u201d<\/p><p>\u201cThis case should concern officials and citizens of every state. If a governor can delay extraditions and cherry-pick cases according to their political tastes, then no state will be able to hold fugitive criminals accountable,\u201d Ellison <span><u>said<\/u><\/span>.<\/p><p>Castro was arrested in May by Texas Rangers who were flanked by investigators with Minnesota\u2019s Bureau of Criminal Apprehension. Since then, ICE\u2019s Office of Professional Responsibility has monitored Castro\u2019s jail calls and turned over summaries of those conversations to Minnesota investigators.<\/p><p>Minnesota officials <span><u>told the judge<\/u><\/span> that Castro has been in communication with a girlfriend in Mexico and plans to reunite with her south of the border.
