The Justice Department called the ruling \u201cgravely erroneous\u201d and said the decision warranted a Supreme Court review.<\/p>\n<p>\u201cThe authority of the U.S. military to determine who may serve in the Nation\u2019s armed forces is a matter of exceptional importance,\u201d the administration\u2019s petition said.<\/p><p>President Donald Trump issued an executive order shortly after his inauguration last year that instructed Defense Secretary Pete Hegseth to bar transgender people from serving in the military \u2014 part of a wider federal effort to significantly roll back <\/span>\n<\/h3><\/div>\n<\/div>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/section>\n<p>Transgender service members and prominent LGBTQ+ rights groups swiftly moved to <span><u>legally challenge<\/u><\/span> the military ban in January 2025, arguing that it was discriminatory and violated the due process clause of the Fifth Amendment. Hegseth, who <span><u>opposes<\/u><\/span> LGBTQ+ people serving in the military, followed through with the  the next month.<\/p><p>Various <span><u>lower-court rulings<\/u><\/span> have tested the ban\u2019s enforceability.<\/p><p>In June, the U.S. Court of Appeals for the D.C. Circuit upheld a district judge\u2019s order that blocked the Pentagon from removing a group of transgender service members from service while their cases proceeded through federal court.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=3151\">Trump Plans to Freeze Civilian Federal Worker Pay for Next Year<\/a><\/p><p>Judge Robert Wilkins  in his majority opinion that there was \u201cdirect evidence\u201d that \u201canimus motivated\u201d Hegseth\u2019s policy.
