{"id":3186,"date":"2026-08-30T06:43:38","date_gmt":"2026-08-30T06:43:38","guid":{"rendered":"https:\/\/modernhomejournals.com\/?p=3186"},"modified":"2026-08-30T06:43:38","modified_gmt":"2026-08-30T06:43:38","slug":"judge-rules-rubios-efforts-to-deport-students-violated-their-right-to-free-speech","status":"publish","type":"post","link":"https:\/\/modernhomejournals.com\/?p=3186","title":{"rendered":"Judge Rules Rubio\u2019s Efforts to Deport Students Violated Their Right to Free Speech"},"content":{"rendered":"<div>\n<div>\n<\/div>\n<div>\n<p>The Trump administration violated the Constitution when it revoked visas and sought to detain noncitizen students for expressing dissent, particularly while condemning Israel\u2019s actions in Gaza, a federal judge in California ruled Friday.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=3178\">DHS Deports Far-Right Provocateur Milo Yiannopoulos<\/a><\/p><p>U.S. District Judge No\u00ebl Wise  that Secretary of State Marco Rubio violated the First Amendment and the Fifth Amendment when he invoked the Immigration and Nationality Act to cancel student visas and initiate deportation proceedings. Rubio <span><u>vowed<\/u><\/span> in March 2025 to crack down on pro-Palestinian international students, saying in a news conference at the time, \u201cEvery time I find one of these lunatics, I take away their visa.\u201d<\/p>\n<p>Tensions escalated last year after federal immigration authorities detained <span><u>Mahmoud Khalil<\/u><\/span>, a student protest leader at Columbia University, and <span><u>R\u00fcmeysa \u00d6zt\u00fcrk<\/u><\/span>, a doctoral student at Tufts University who wrote an opinion piece for the student newspaper. Those arrests and others spurred criticism from free-speech advocacy organizations.<\/p><p>Stanford University\u2019s student-run newspaper and an unnamed female student with an F-1 visa sued Rubio in August 2025, arguing that his policy was stifling free speech on college campuses. It is not the government\u2019s to take.\u201d She said President Donald Trump\u2019s administration has followed a pattern of targeting dissent, including pro-Palestinian support, <span><u>critiques<\/u><\/span> of conservative political activist Charlie Kirk after he was fatally shot, and opinions about the Iran war.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=3176\">Trump Announces Agreement to Partially Control Venezuela\u2019s Oil Reserves<\/a><\/p><p>\u201cThis downward spiral is antithetical to our Constitution that recognizes our right to speak freely,\u201d wrote Wise, a Joe Biden appointee. \u201cHere you can simultaneously hate the content of a person\u2019s speech and love the country that cherishes the freedom to allow it. Zealous protection of our Constitutional right to free speech is a provocative demonstration of our country\u2019s powerful lack of fear.\u201d<\/p><p>The State Department did not immediately respond to a request for comment Saturday on Wise\u2019s ruling.<\/p><p>The Foundation for Individual Rights and Expression, a civil rights organization that helped litigate the case, <span><u>said<\/u><\/span> in a statement that Wise\u2019s ruling \u201cproves that free speech isn\u2019t a privilege, but the inalienable right of every man, woman, and child.\u201d<\/p><p>While Wise\u2019s ruling found the Trump administration\u2019s actions to be unconstitutional, she stopped short of ordering the government to cease its deportation threats because only the Supreme Court has the authority to block that provision.<\/p><p>Read more <a href=\"https:\/\/modernhomejournals.com\/?p=3170\">Yosemite Is Facing More Development.
