Americans want the Trump administration to leave \u201cThe View\u201d alone, according to a smattering of nearly 40,0000 public comments<\/u><\/span> \u2014 and counting \u2014 the Federal Communications Commission has received regarding its probe into the popular program.<\/p>\n

\u201cAllow \u2018The View\u2019 to exercise their First Amendment\u2019s right. The ladies do a wonderful job communicating many issues that impact our country,\u201d said one woman who wrote in after both ABC<\/u><\/span> and FCC Chairman Brendan Carr<\/u><\/span> called on the public to jump into the conversation on Monday.<\/p>\n

\u201cProtect the Constitutional right to freedom of speech! I support ABC and the rights of those on the View \u2014 even when I disagree,\u201d another woman wrote Wednesday.<\/p>\n

\u201cI watch the View. I am a registered Republican and do not agree with all of the opinions. However, I strongly object to this kind of censorship. This is ridiculous. What is happening to the free press? Do NOT allow this to go through,\u201d a woman chimed in Wednesday.<\/p>\n

The FCC is reviewing whether \u201cThe View\u201d qualifies for the equal-time exemption for its political interviews, News programs are exempt from federal law that requires equal time for political candidates\u2019 viewpoints, and ABC says that its show meets the requirements as a \u201cbona fide news interview program.\u201d<\/p>\n

The comments, by and large, seem to suggest Americans want the government\u2019s hands off the popular daytime program. The number of comments more than doubled from around 18,000 on Tuesday to more than 40,000 Wednesday. The public comment period ends July 6.<\/p>\n

The influx of comments to the FCC\u2019s docket isn\u2019t common, and the trove of support is evidence that the public is \u201cconcerned\u201d and \u201cangry\u201d about the FCC\u2019s probe, Jenna Leventoff, senior policy counsel at the ACLU, told NOTUS.<\/p>\n

\u201cRegulatory comments are primarily filed by interested organizations, and are less frequently filed by individuals who are interested, as is happening here,\u201d Leventoff said.<\/p>\n

Americans who took the time to write into the FCC appear to span the ideological spectrum, with many expressing concern about the FCC\u2019s potential regulatory crackdown on the nearly 30-year-old TV program.<\/p>\n

Three libertarian and right-leaning groups wrote in a joint letter<\/u><\/span> to the FCC that it should back off.<\/p>\n

\u201cConservatives have always objected to government control of media. \u2026 Any effort to legitimize such efforts by embedding them into FCC regulations will soon be wielded against conservative outlets,\u201d the Competitive Enterprise Institute, Taxpayers Protection Alliance and Young Voices said.<\/p>\n

Congress amended the Communications Act in 1959 to include the equal-time exemption<\/u><\/span>. Programs that do not qualify for the exemption must provide \u201creasonable access\u201d to legally qualified candidates for federal office, according to a separate 1971 amendment<\/u><\/span> to the law.<\/p>\n

Free speech advocates and civil rights groups say the FCC\u2019s decision to investigate \u201cThe View\u201d upends decades of regulatory precedent.<\/p>\n

\u201cThe Commission has refused to ask this question of any program for 40 years, because the government cannot constitutionally be the arbiter of what counts as news,\u201d the ACLU, Center for Democracy & Technology, Future of Free Speech and National Coalition Against Censorship wrote in a to the FCC, which oversees all over-the-air broadcasts.<\/p>\n

Sens. Ted Cruz (R-Texas) and Ron Wyden (D-Oregon) introduced the JAWBONE Act in June to create a more effective pathway for plaintiffs to seek monetary damages against the government for pressuring private entities into censoring protected speech, a tactic the senators call jawboning.<\/p>\n

When the FCC in 2006 that interview segments on \u201cThe Tonight Show\u201d qualified for the exemption, the commission effectively reversed its 1960 decision \u2014 also involving \u201cThe Tonight Show\u201d \u2014 that explicitly said late-night talk shows were ineligible for the carve-out. Late-night and daytime talk shows have relied on the 2006 ruling since, but the FCC put the programs on notice in January.<\/p>\n

\u201cThese decisions are fact-specific and the exemptions are limited to the program that was the subject of the request,\u201d the FCC wrote.<\/p>\n

Even though the FCC\u2019s Mass Media Bureau confirmed \u201cThe View\u2019s\u201d status as a \u201cbona fide news interview program\u201d in a 2002 declaratory ruling, the commission opened a probe into \u201cThe View\u201d in February after the show hosted Senate candidate James Talarico (D-Texas).<\/p>\n

ABC filed a new petition<\/u><\/span> in May asking the commission to reaffirm its previous ruling.<\/p>\n

First Amendment experts said the FCC\u2019s probe, regardless of the regulatory outcome, is having a chilling effect on free speech.<\/p>\n

\u201cWhere there\u2019s too many candidates, there\u2019s never enough time,\u201d Ashkhen Kazaryan, senior legal fellow at the Future of Free Speech, told NOTUS. \u201cThe chilling effect would be on the shows themselves, because they will think twice before booking candidates.\u201d<\/p>\n

Kazaryan said many media companies will opt to \u201cself-preserve\u201d rather than enter costly legal battles, meaning the FCC merely \u201cthreatening this regulation\u201d effectively suppresses free speech.<\/p>\n

\u201cThe Late Show\u201d with former host Stephen Colbert, before his ouster by CBS, decided to air its interview with Talarico<\/u><\/span> on YouTube rather than its TV broadcast to avoid triggering an FCC probe similar to \u201cThe View\u2019s.\u201d<\/p>\n

Leventoff said she believes the FCC is \u201cnot factoring in that Americans get their news from so many different places,\u201d by reviewing whether late-night and daytime talk shows are legitimate news programs.<\/p>\n

\u201cThis proceeding isn\u2019t just about one TV show,\u201d Leventoff said. \u201cThe FCC has shown a willingness to enforce its rules based on what it thinks of the show it\u2019s enforcing rules against\u201d<\/p>\n

It remains unclear whether the FCC will grant \u201cThe View\u201d the exemption \u2014 though Carr told Fox News<\/u><\/span> the long-running show faces an \u201cuphill climb.\u201d<\/p>\n
